These terms cover your use of scrth, a macOS app made by ShelTech (“we”, “us”). By installing or using scrth you agree to them. They are written to be read, not to be endured — if something here is unclear, ask us.

1. Your licence to use scrth

We grant you a personal, non-exclusive, non-transferable licence to install and use scrth on Macs you own or control, for as long as you comply with these terms. If you obtained scrth through the Mac App Store, Apple’s Licensed Application End User License Agreement also applies, and where it conflicts with these terms, it wins.

We keep all rights we do not expressly grant. You may not copy, sell, rent, sublicense, reverse engineer, decompile, or attempt to derive the source code of scrth, except where that restriction is prohibited by law.

2. Your notes are yours

scrth stores your notes locally on your Mac. We claim no ownership of anything you write, and we do not receive it — see theprivacy policy. You are responsible for what you put in your notes and for complying with the law where you are.

3. Notes are designed to disappear

scrth is a scratchpad for temporary notes. Notes expire, fade and are permanently deleted according to the lifecycle settings in the app. This is the product working as intended, not a fault. scrth is not a backup service, an archive, or a system of record. Keep anything you need to keep somewhere built to keep it.

4. Payment, if any

Where scrth is sold, purchases are handled by the store you bought it from (for example the Mac App Store), and that store’s payment, refund and subscription terms apply. We do not process payments ourselves and cannot issue refunds on a store’s behalf.

5. Provided as-is; no warranty

scrth is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that scrth will be uninterrupted, error-free, or that it will preserve any particular note. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

6. Limitation of liability

To the fullest extent permitted by law, ShelTech will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, notes, profits, or business, arising out of or relating to your use of or inability to use scrth — even if we have been advised that such damages are possible.

To the fullest extent permitted by law, our total liability for all claims relating to scrth is limited to the amount you actually paid for the app in the twelve months before the claim, or, where the app was free, to zero. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

7. Acceptable use

Do not use scrth to break the law, to infringe someone else’s rights, or to interfere with the security or integrity of any system. Do not circumvent technical restrictions in the app or in the store you obtained it from.

8. Ending the agreement

You may stop using scrth at any time by deleting it. Your licence ends automatically if you materially breach these terms. Sections 5 and 6 survive the end of this agreement.

9. Changes to the app and to these terms

We may update scrth, and we may change these terms — for example when the app itself changes. When we do, we will update the date at the top of this page and publish the new version here. Material changes will be highlighted in the app or on this site where practical. Continuing to use scrth after a change means you accept the updated terms. If you do not accept them, stop using the app.

10. The rest

If any part of these terms is found unenforceable, the rest stays in force. Our not enforcing a term is not a waiver of it. These terms, together with the privacy policy, are the whole agreement between you and ShelTech about scrth.
